Chapter 4

-         LABOR STANDARDS – are set and revised by the Industrial Welfare Commission (IWC, Department of Industrial Relations) in the State of California.  Three orders cover most agricultural employment –

-         Orders 8 – off-farm post-harvest handling and processing of crops

-         Order 13 – on-farm preparation of crops for market.

-         Order 14 – covers on-farm field work occupations.

-         OVERTIME – paid after 10 hours in a workday or after 8 hours worked on the seventh consecutive day.

-         Federal Taxes required – 1. Federal Income Tax  2.  Social Security (FICA) 3. Federal Unemployment Tax (FUTA).

State – 1. California Income Tax  2. CA Unemployment Tax (UI)  3. State Disability Insurance (SDI).

-         Mandatory benefits -  Workers compensation – Unemployment Insurance – Leave of Absences (FMLA) & (FCMLA) – reasonably accommodate literacy needs.

-         Optional benefits -  Vacation, Pensions, Medical Insurance, Housing, miscellaneous such as a company vehicle, daycare.
