At will employment –
Unless you are a government employee or have a contractual agreement (specific
duration or other condition) – employment is terminable by either party at any
time. -
Constructive Discharge
– An employer effectively compels (forces) the employee to terminate
the employment relationship. -
Retaliation –
Employers may not penalize employees for exercising rights granted them under
labor laws – example filing a
report of illegal conduct such as sexual harrassment. -
Refusal to work in Unsafe Conditions - An
employee cannot be fired or laid off for refusing to work in an unsafe job. -
Employee discipline should be progressive: 1. Education 2. Verbal warning 3. Written warning 4. Final warning with explicit consequences. It
should provide adequate warning – based on company rules – and fair and
consistent across the board for all employees. -
